Simarc's invalid sub-letting Fees Clause 7.13.2 of the lease states: "...no consent shall be required for an underletting of the whole flat by way of an Assured Shorthold Tenancy for a term of twelve months or less (and such underlettings being described as a Permitted Under-Letting)". Furthermore, in accordance with the provisions of the Commonhold and Leasehold Reform Act 2002 Section 96 (2) all management functions (including consents) pass to the Right To Manage Company
The first company AGM was held on 6 August 2015 at which leaseholders agreed a reduction of just over 21% in Service Charges for Croft House and Newport House for the year commencing 1 October 2015. Contractor Appointments the company has appointed Stratton Gardening Contractors to maintain the grounds around Croft House and Newport House and BestCleaners4U to clean the communal areas of the two blocks.
Mainstay has erroneously issued Service Charges for Croft house and Newport House for the period commencing 1 October 2015. Despite a complaint to Mainstay's Managing Director Luke Sanders Mainstay has now issued Arrears Notices to leaseholders. These have been issued despite Mainstay no longer having any legal right to provide management functions in respect of Croft
House and Newport House and the appurtenant property. (i.e. The Estate).
